Terms of Service

These Terms of Service ("Terms") govern your use of the Episodeo website, waitlist, and mobile app (together, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Acceptance of these Terms

By creating an account, joining the waitlist, signing in, or otherwise using Episodeo, you accept these Terms and our Privacy Policy. If you use Episodeo on behalf of someone else, you confirm that you are allowed to accept these Terms for them.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your country, to use Episodeo. By using the Service, you confirm that you meet this requirement. Episodeo may ask for birth date or age information during account creation to confirm eligibility.

3. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Please notify us promptly if you believe your account has been accessed without permission.

You agree to provide accurate information and to keep your account information reasonably up to date.

4. License to use Episodeo

Episodeo grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial tracking of movies, series, anime, and related content, in accordance with these Terms.

You may not copy, sell, sublicense, reverse engineer, interfere with, or exploit the Service or its underlying software except where permitted by law.

5. Acceptable use

You agree not to:

• Break the law or infringe the rights of others while using the Service.
• Post content that is illegal, hateful, harassing, threatening, abusive, defamatory, sexually exploitative, or infringing.
• Post spam, malware, scams, or deceptive content.
• Impersonate another person or misrepresent your identity.
• Attempt to disrupt, overload, reverse engineer, scrape, or gain unauthorized access to the Service.
• Use the Service to collect data about other users without permission.

Episodeo may remove content, limit features, suspend accounts, or terminate access where we reasonably believe these Terms have been violated or where there are safety, legal, abuse, or security risks.

6. Your content

You keep ownership of the content you create in Episodeo, such as reviews, ratings, comments, lists, journal entries, profile details, and other content you submit ("Your Content").

By posting, importing, or sharing Your Content, you grant Episodeo a limited, worldwide, non-exclusive, royalty-free license to host, store, process, display, reproduce, and distribute that content only as needed to operate, provide, secure, and improve the Service. For example, this allows Episodeo to show a public review to other users or sync your imported watch history to your account.

This license ends when you delete the content or your account, except where content has already been shared with others, is retained in backups for a limited period, or must be kept for legal, security, or abuse-prevention reasons.

You are responsible for Your Content and confirm that you have the rights needed to submit it.

7. Imported data

Episodeo may let you import watch history or related data from other services by providing an export file. You are responsible for making sure you have the right to use and upload that file.

Episodeo does not ask for login credentials from those services. Imported data may be processed and stored so Episodeo can recreate your watch history, ratings, comments, lists, and related content inside your account.

8. Third-party content and services

Episodeo may display or link to third-party metadata, artwork, ratings, streaming availability, GIFs, soundtrack information, websites, or services. This content belongs to its respective owners and may be subject to their own terms.

Episodeo is an independent app and is not affiliated with, endorsed by, or sponsored by any third-party tracking service, studio, network, metadata provider, streaming provider, or rights holder unless expressly stated.

We do not guarantee that third-party metadata, artwork, availability, ratings, or search results will always be accurate, complete, or available.

9. Intellectual property

The Episodeo name, logo, website, app, design, software, and related materials are owned by Episodeo or its licensors and are protected by law. These Terms do not give you ownership of Episodeo or its intellectual property.

You may not use Episodeo branding, logos, or materials without permission, except where allowed by law.

10. Beta and availability

Episodeo is evolving and may include beta or pre-release features. We may add, change, suspend, or remove features at any time. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

We may also limit access, invite users gradually, or change launch timelines.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Episodeo disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

You use the Service at your own risk. We do not guarantee that data, including imported data, will always be accurate, complete, preserved, or recoverable.

12. Limitation of liability

To the maximum extent permitted by law, Episodeo will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of data, profits, goodwill, or business opportunity, arising from your use of or inability to use the Service.

Nothing in these Terms limits liability that cannot be limited under applicable law.

13. Account deletion and termination

You may stop using Episodeo at any time. You can delete your account or delete your app data from Settings → Danger Zone in the app, or request deletion by emailing episodeoapp@gmail.com.

We may suspend or terminate your access if you violate these Terms, create risk for other users, create legal or security risk, or misuse the Service.

After termination or deletion, some limited information may remain where required for legal, security, backup, or abuse-prevention reasons, as described in the Privacy Policy.

14. App stores and third-party terms

If you download Episodeo through an app store or beta testing platform, that platform's terms may also apply. Those terms are between you and the platform provider, not Episodeo, except where the platform rules say otherwise.

15. Governing law

These Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. This does not limit any mandatory consumer protection rights that may apply in your country of residence.

16. Changes to these Terms

Episodeo may update these Terms from time to time as the Service evolves. Changes will be posted on this page with an updated date. For material changes, we may also provide notice in the app or by email where appropriate.

Continued use of the Service after changes means you accept the updated Terms.
